Terms of Service

1. Acceptance of Terms

ExamRift ("the Service") is operated by PAN-U INFORMATION COMPANY LIMITED (the "Company", "we", or "us"). By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

ExamRift is a language exam preparation and learning platform. We provide practice questions, mock exams, AI-powered grading, vocabulary tools, and study planning features for various language proficiency tests.

3. User Accounts

You must create an account to access most features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 13 years old to use the Service.

4. Action Points (AP) System

The Service uses an "Action Points" (AP) system to manage feature access:

  • AP is not a virtual currency or stored-value product. AP represents a regenerating usage allowance, similar to a stamina or energy system. AP cannot be exchanged for money, transferred to other users, or redeemed for cash.
  • AP recovers automatically over time. Every account regenerates AP at a fixed rate determined by its plan tier (Free, Plus, or Intense). AP is not "purchased" or "deposited" — it is a feature of your active plan.
  • AP capacity and recovery rates may change. We reserve the right to adjust AP capacity limits, recovery rates, feature costs, and bonus amounts at any time. Material changes will be communicated in advance.
  • AP has no monetary value and is non-refundable. Because AP regenerates continuously and is not purchased as a discrete product, there is no balance to "refund." Cancelling your subscription stops the enhanced recovery rate but does not entitle you to compensation for unused AP.
  • AP top-ups (subscribers only) are one-time convenience purchases available exclusively to users with an active subscription. Top-up AP is delivered immediately to your account balance. Top-ups are non-refundable once purchased.
  • Bonus AP from login streaks, milestones, or promotions is granted at our discretion and may be modified or discontinued at any time.

5. Subscriptions and Billing

  • Paid subscriptions (Plus and Intense) are billed in advance on a recurring basis (monthly, quarterly, or semi-annually) through our payment processor.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain your plan's AP recovery rate until the period expires.
  • Refunds for subscription fees are handled according to our Refund Policy and applicable consumer protection laws. Partial-period refunds are not provided except where required by law.
  • We may change subscription pricing with at least 30 days' notice. Price changes take effect at your next billing cycle.

6. Reverse Trial

New accounts receive a 14-day trial with Plus-level AP capacity and recovery rates at no charge. After the trial period, your account automatically reverts to the Free tier unless you subscribe to a paid plan. No payment information is required for the trial, and no charges will be made without your explicit consent.

7. AI-Powered Features

AI grading, feedback, and practice performance estimates are generated by third-party AI models and are provided for educational guidance only. They do not constitute official test scores or certified assessments. Accuracy is not guaranteed, and results may vary.

8. Intellectual Property

All content on the Service — including questions, passages, audio, UI design, and software — is owned by or licensed to ExamRift. You may not reproduce, distribute, or create derivative works from our content without written permission. Your submitted answers and recordings remain yours, but you grant us a license to use them for improving the Service (e.g., training AI models, quality assurance).

9. Prohibited Conduct

  • Sharing accounts or credentials with others
  • Using automated tools, bots, or scripts to interact with the Service
  • Attempting to manipulate the AP system (e.g., exploiting recovery timing, creating multiple accounts for bonus AP)
  • Scraping, copying, or redistributing questions or content
  • Interfering with the Service's operation or other users' access

10. Referral Program

  • Eligibility. Any registered user may participate in the referral program by sharing their unique referral link or code.
  • Referee reward. A new user who signs up via a referral link receives a one-time bonus of 50 AP credited to their account upon registration.
  • Referrer reward. When a referred user subscribes to a paid plan and maintains an active subscription for at least 10 consecutive days, the referrer receives 1 month of Intense access. If the referrer already has an active paid subscription, redemption is coordinated with our support team; automated extension for active subscribers is not yet available.
  • One referral per user. Each new user can only be referred once. If a user has already registered, a referral code cannot be applied retroactively.
  • No self-referral. You may not use your own referral code to create another account.
  • Fraud prevention. We reserve the right to revoke referral rewards, suspend accounts, or terminate program participation if we detect fraudulent activity, including but not limited to: creating fake accounts, using disposable email addresses to generate referrals, or coordinating with others to abuse the program.
  • Program modification. We may modify, suspend, or discontinue the referral program at any time. Changes to reward amounts or qualification criteria will not affect rewards already earned or pending qualification.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee that using the Service will result in specific test scores or outcomes. Our total liability to you for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through Settings. Upon termination, your AP balance, study data, and progress are permanently deleted after a 30-day grace period.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notification at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of China (Taiwan). Any disputes shall be submitted to the exclusive jurisdiction of the Taiwan Tainan District Court as the court of first instance.
